If you are a Randolph-Brooks Federal Credit Union (RBFCU) member and money was moved out of your checking or savings account without your authorization, often through fast, hard-to-reverse RTP or Zelle "push" payments to a payee you never set up, you may have a claim under the Electronic Fund Transfer Act (EFTA), 15 U.S.C. section 1693, et seq.

 

We hear the same story from members again and again: a criminal takes over the account, drains it in minutes, and when the member reports the fraud, RBFCU denies the claim, calls the transfers "authorized," and refuses to refund the stolen money. In some denials, the credit union even treats the fingerprints of the takeover, a new device logging in, changed account information, a payee added moments before the money left, as its reason to deny the claim, and tells the member to "contact the merchant" when there was no merchant at all, only a person-to-person transfer.

 

That is not a lawful investigation, and that denial letter is not the end of your case. Under the EFTA, RBFCU is required to limit your liability when you report promptly, conduct a genuine investigation, provisionally credit your account when the law requires it, and hand over the documents it actually relied on to deny you. When a credit union cuts those corners, you may be entitled to repayment of your actual losses, plus up to $1,000 in statutory damages, plus (in some cases) triple damages, and even full payment of your attorney's fees by RBFCU, not you.
