In this regard, Attorney Adams can put his years of successful debt collection experience to work for you. Attorney Adams is experienced in handling high value, large debt collection cases. Mr. Adams has appeared in various state, federal district and bankruptcy courts and has obtained substantial recoveries on numerous claims. Some of his clients have included insurance companies, financial institutions, healthcare facilities, contractors, manufacturers and telecommunications companies. In addition to the use of standard civil process against debtors, Mr. Adams has been successful in procuring recovery through the institution of the rarely-used involuntary bankruptcy petition procedure under § 303(b)(1) of the Bankruptcy Code. In one case, while representing the international telecommunications carrier, Sprint Communications Company, Mr. Adams organized and led a team of creditors with aggregate claims of $1.4 million against a debtor corporation. Without the efforts of Mr. Adams and his role as lead counsel in the case, no assets would have been available for distribution to creditors. See, In re: VoiceSmart Corp., 2000 WL 33950132 (Bankr. D.N.J.). Click here for more information about this case—scroll down on the "Success Stories" page.

How to Domesticate a Judgment?

Many times, a debtor will be sued in one state but may not have any assets in that state to be levied upon. In such cases, it may be advisable to have the judgment filed of record in another state where the debtor either has a physical presence or has assets which can be levied upon or garnished. Judgments entered and obtained in one state can be given full force and effect in another state under the “Full Faith and Credit” clause set forth in Article IV, Section 1 of the United States Constitution. Each state has its own specific procedural rules for filing foreign judgments within its borders. The process of having a foreign judgment registered in another state is also known as “domestication”, that is to say the foreign judgment is being “domesticated” in a state other than where the original judgment was entered and obtained.
